Berman wrote in his opinion that releasing the transcripts could endanger victims who have spoken out against Epstein and that the materials contain scant information anyway. He added that the onus is on the government, not the courts, to release any investigatory materials that could be in the public interest.
“The government is the logical party to make a comprehensive disclosure to the public of the Epstein files,” Berman wrote. “The grand jury testimony is merely a hearsay snippet of Jeffrey Epstein’s alleged conduct.”
Berman, who was appointed by President Bill Clinton, said that Attorney General Pam Bondi reneged on promises to release investigatory materials in the high-profile case and that the request for the grand jury materials was a “‘diversion’ from the breadth and scope of the Epstein files in the government’s possession.”
Berman noted that the grand jury material consists of about 70 pages and includes just one interview with an FBI agent that was conducted in New York in 2019 as part of the Justice Department’s sex trafficking investigation into Epstein. By contrast, Berman said, the government has 100,000 pages of Epstein investigatory materials in its possession.
The latest refusal comes days before the Justice Department is expected to begin sharing some of the Epstein investigatory files with Congress in response to a subpoena from the House Oversight Committee….
