It seems in todays arguments before the justices that the sweeping mandate issued by the Biden admin thru Occupational Safety and Health Administration (OSHA) for ALL business’s will be rejected….
But the Supreme’s may give the President a half of a loaf in supporting his ability to order vaccines or testing for those healthcare workers whose salaries are supported by Medicare or Medicaid Federal funding….
Biden’s people are well aware that private business mandates come from the states or Congress…
Not from President’s….
The court’s decision could come quickly — it is considering emergency petitions to either allow the regulations to go into effect or stop them.
The court spent three and half hours in a highly unusual hearing on the emergency requests. The workplace rule is proposed by the Occupational Safety and Health Administration (OSHA) and would cover about 80 million workers. The other would cover about 17 million health-care workers….
A majority of justices seemed inclined to agree with private businesses and Republican-led states that OSHA’s proposed action seemed more in line with what states or Congress might dictate, rather than a federal agency.
Such a workplace requirement “sounds like the sort of thing that states will be responding to or should be, and that Congress should be responding to or should be, rather than agency by agency, the federal government, the executive branch acting alone,” said Chief Justice John G. Roberts Jr….
