The Justice Department confirmed Saturday it was conducting an antitrust probe into the networks over their decision last month to pause participating in pooled video coverage of the president.
Under the White House pool system, the networks — ABC, CBS, CNN, Fox News and NBC — rotate responsibilities for gathering and distributing footage of the president’s daily movements. In September, after the White House barred CNN, along with Politico and MS NOW, from the White House grounds, the TV pool paused its coverage in solidarity for several days. The TV pool resumed coverage after a federal judge ordered the White House to restore access to CNN, Politico and MS NOW, though the targeted news outlets have not been allowed to ride on Air Force One for pool duty.
In its statement Saturday, the Justice Department said that “group boycotts among commercial competitors” can violate federal antitrust laws.
But legal experts reacted with considerable skepticism to the reported investigation.
“Any objective analysis of what’s happened here would not require any kind of an investigation whatsoever,” said Bill Baer, who led antitrust enforcement at the Justice Department during the Obama administration. “It looks like total retaliation.”
The Justice Department‘s contention appears to be that the pool’s decision to pause coverage was an example of an illegal boycott. But boycotts are generally scrutinized when they are pursued for economic motives, Baer said, while speech is a different matter….
…
The exact scope of the investigation is not clear. ABC said late Saturday that it did not receive notification of the investigation but expects to. Another network had received the notification by late Saturday, according to a person familiar with the situation, who spoke on the condition of anonymity to share sensitive details.
