The federal mortgage fraud investigation against Democratic Sen. Adam Schiff, one of President Donald Trump’s chief political foes, has stalled, according to four people familiar with the investigation.
After months of investigating, the federal prosecutors in Maryland leading the probe have not produced enough evidence to bring charges, these people said.
One of the sources, a federal law enforcement official, said the investigation “came to a standstill.”
Kelly Hayes, the U.S. attorney overseeing the investigation, met with Deputy Attorney General Todd Blanche earlier this week and asked him how to proceed, according to three people with knowledge of the meeting. The decision out of that meeting was for Hayes to pursue more evidence, and the case remains ongoing, those people said.
“No final decision has been made,” one of the sources said.
The sources spoke on the condition of anonymity because they were not authorized to comment on the ongoing investigation.
The White House referred a request for comment to the Justice Department, which has not responded.
Schiff served as the lead impeachment manager in the House during Trump’s first impeachment trial in 2020. He has denied any wrongdoing in response to the Trump administration’s investigation into mortgage fraud allegations.
In a statement, Schiff’s attorney Preet Bharara said: “It seems pretty clear that a team of career prosecutors have thoroughly reviewed the politically-motivated allegations against Senator Schiff and found they are unsupported by any evidence and are baseless.”
“The transparently vindictive effort to pursue the Senator has no merit, and if there is any justice left in the Justice Department, this should be the end of the matter,” Bharara added….
Letitia James, New York’s attorney general and a longtime critic of Mr. Trump, pleaded not guilty on Friday to charges lodged by the Trump administration over whether she misled a bank to get more favorable mortgage terms.
Ms. James faces one count of bank fraud and one count of making a false statement to a financial institution. Appearing before Judge Jamar Walker of Federal District Court in Norfolk, Va., Ms. James said: “Not guilty, judge, to both counts.”
The hearing for Ms. James, her first court appearance since being indicted this month, is a routine opening procedure in a prosecution that is anything but. How her case, which was pursued at President Trump’s demand over the objections of career prosecutors, plays out could hold signals for the president’s wider efforts to seek retribution against his perceived enemies.
A tentative trial date was set for Jan. 26, with pretrial motions and hearings expected in November and December. Prosecutors said they expected the trial to take about a week and feature eight to 10 witnesses. After a hearing that lasted about 35 minutes, Ms. James was released with no conditions on bail.
Outside the court, dozens of protesters chanted, “We stand with Tish.” Speaking to supporters afterward, Ms. James declared, “I have this belief in the justice system and the rule of law,” adding, “There is no fear.”
“This is not about me,” she added. “This is about all of us and a weaponized justice system, this justice system which has been used as a tool of revenge.”
Ms. James has said the charges against her — one count of bank fraud and one count of making a false statement to a financial institution — are “baseless.”
Ms. James stands accused of lying about her purpose in buying a house in Virginia in 2020. Prosecutors say that while she said the house would be a secondary residence, she in fact used it as a “rental investment property,” renting it to a family of three.
But Ms. James’s great-niece has lived in the house since 2020, and testified to a Norfolk grand jury that she does not pay rent. Ms. James has reported only $1,350 in rent from the property on her tax forms….
