Giving Trump a chance to beg Alito & Co. to Bail him Out……
The U.S. Court of Appeals for the Federal Circuit upheld a lower court’s decision that Trump overstepped his authority in using a 1977 law, called the International Emergency Economic Powers Act, or IEEPA, to impose most of his tariffs. The emergency law is used in the case of threats against the country.
“The statute bestows significant authority on the President to undertake a number of actions in response to a declared national emergency, but none of these actions explicitly include the power to impose tariffs, duties, or the like, or the power to tax,” a group of federal judges wrote in their ruling.
The decision throws the future of Trump’s foundational economic policy into uncertainty once more, just weeks after the president announced increased levies on more than 60 countries around the world. Those tariffs spared many countries from even higher levels first proposed by Trump in April, but still added much higher taxes than the country has imposed in recent decades.
Trump posted on Truth Social Friday criticizing the decision, writing that a “Highly Partisan Appeals Court incorrectly said that our Tariffs should be removed, but they know the United States of America will win in the end. If these Tariffs ever went away, it would be a total disaster for the Country.”
The legal challenge was brought by a group of state governments and small businesses, who argued, in part, that no such emergency exists to justify Trump using the law. The Trump administration has disputed this, pointing to an executive order Trump signed earlier this year declaring the trade deficit a national emergency…..

The Appeals Court backs a lower Federal Trade Court ruling against Trump’s actions…
A federal appeals court ruled on Friday that many of President Trump’s most punishing tariffs are illegal, delivering a major new setback to the administration that may severely undercut its primary source of leverage in an expanding global trade war.
The ruling, from the U.S. Court of Appeals for the Federal Circuit, affirmed a lower court’s finding that Mr. Trump does not possess unlimited power under the law to impose taxes on nearly all U.S. imports. But the appellate judges delayed the implementation of their order until October to grant the administration time to seek review by the Supreme Court, which would allow Mr. Trump to keep his contested duties in place for now.
At the heart of the fight is the extent to which Mr. Trump may invoke a decades-old economic emergency law to issue withering tariffs on the nation’s foremost trading partners. The law does not mention tariffs, but the president has seized on the statute to apply vast new duties anyway, aiming to remake U.S. trade relationships and raise billions of dollars in revenue.
Mr. Trump’s claims to sweeping trade power immediately drew legal challenges from small businesses and states, which said they were harmed financially by taxes on foreign goods that the president had no right to impose. In May, a federal trade court agreed, invalidating many of the president’s duties on grounds that the law did not grant him “unbounded authority” to wage his global trade war….

Executive Order Tariff/Import Taxes?
A federal appeals court on Friday found that many of President Trump’s tariffs were issued illegally, upholding an earlier decision from a federal trade court, which ruled against the White House and its use of an international emergency powers law as the basis for waging its global trade war.
The appeals court specifically found that the bedrock of that trade war — a law enacted in the 1970s that permits the president to take broad trade action in response to economic emergencies — “does not authorize the tariffs imposed by the Executive Orders” that were challenged by small businesses and states earlier this year….
