President Biden’s call Thursday to make an exception to filibuster rules to pass legislation protecting abortions is likely to be a tough sell with a pair of Senate Democrats: Kyrsten Sinema of Arizona and Joe Manchin III of West Virginia.
Both continued to defend the tradition of the filibuster after the leak in early May of a draft Supreme Court opinion that signaled the court was on the verge of overturning Roe v. Wade.
At the time, Sinema pointed to its use in the past so that Democrats could prevent Republicans from imposing abortion restrictions.
“Protections in the Senate safeguarding against the erosion of women’s access to health care have been used half-a-dozen times in the past 10 years, and are more important now than ever,” she said.
On Thursday, a Sinema aide referred reporters to her previous statements.
Manchin has said in recent days that he would support writing abortion protections into law, but he, too, has suggested that shouldn’t be done by altering the filibuster rules, which require 60 votes for most legislation to advance.
“The filibuster is a protection of democracy,” Manchin said after the draft court opinion on abortion leaked.
On Thursday, Manchin spokeswoman Sam Runyon said, “His position hasn’t changed.”
