Donald Trump’s attorneys have met in person with Georgia prosecutors who are considering possible criminal charges against the former president for calling the state’s top election official and demanding he “find” more votes, Rachel Maddow reported on her program Monday.
Prosecutors have spent months investigating the bombshell phone callbetween Trump and Georgia Secretary of State Brad Raffensperger (R) that was made on Jan. 2, 2021.
“All I want to do is this: I just want to find 11,780 votes,” Trump said in the call,which was recorded by Raffensperger.
“There’s nothing wrong with saying, you know, that you’ve recalculated,” Trump added.
Maddow reported no details of the talks between Trump lawyers and prosecutors. She pointed out that the probe is the only known criminal investigation into Trump’s attempts to overturn his election defeat.
Raffensperger released the recording to the press after Trump falsely claimed in a tweet that the secretary of state “didn’t have a clue” about election issues….
But it is a mistake to ignore the critical role that others play in upholding the rule of law and deterring future coups.
The Associated Press reports: “The prosecutor weighing whether Donald Trump and others committed crimes by trying to pressure Georgia officials to overturn Joe Biden’s presidential election victory said a decision on whether to bring charges could come as early as the first half of this year.” Fani Willis, district attorney for Fulton County, Ga., says she is “making solid progress, and she’s leaning toward asking for a special grand jury with subpoena power to aid the investigation.”….

1. I already mentioned this today on here and “broke” the news
2. It appears to be some kind of “Special Grand Jury” and not a criminal grand jury. It cannot indict anyone on it’s own. There are some legal differences.

It DOES NOT say no criminal charges can come from the ‘special’ session….
And here’s the 411 on this…..
A special grand jury is unique in that it focuses on just one investigation, and can be impaneled for a longer time than typical grand juries. Willis wrote that the special grand jury will have “an investigatory focus appropriate to the complexity of the facts and circumstances involved.”
She noted that it will not have the power to indict, but will be able to recommend criminal prosecutions “as it shall see fit.”….

Any decision to charge Trump in Georgia will be made by the elected Fulton County States Attorney, not the Grand Jury.

You see, that every piece on this describes it as a “special” Grand Jury.
So, that can also mean “different” from your original assumption.
Lots of Grand Juries though simply make recommendations. This particular effort in Georgia seems to be about determining who might or might not be compelled to participate in the investigation.

With the little legal knowledge I have (an Associate’s in Criminal Justice & Paralegal Studies), and not knowing the specifics of Georgia’s criminal code and code of criminal procedure, let me say that a prosecutor (which Jack has been at times) can usually prefer felony charges in one of two ways:
(1) by presenting an indictment to a grand jury, which can vote (or not vote) a true bill of indictment, or
(2) by preferring a criminal information, and then showing a court (as in many Perry Mason episodes) with enough testimony (rebuttable by defense attorneys) to show probable cause to try the case.
¶ And there’s absolutely NO NEED for anyone to prove how rightly or wrongly anyone else here has behaved : there’s enough room to argue the points and the facts without exploring or impugning anyone else’s possible personal faults (as opposed to errors). I come here to read about politics and public affairs, not this decades-long bloody soap opera psychodrama. Don’t get defensive and answer back, because I don’t have time to read replies about (mis)behaviour as opposed to the substance. For example, I won’t take personal offence at someone correcting or trying to correct what I wrote above prosecutions (not all of which may be accurate or precise). Rant is over; don’t respond.
