It’s been more that 2 weeks ago that the protestor crowds showed up at the nation ‘s Capitol and bum rushed the place…
The protest we find out included some people who had more serious plans….
The actions included vandalism , theft , assaults and reports of some wanting ‘capture’ lawmakers and a noose for Vice President Pence….
The FBI HAS been vacuuming up those involved with the number arrested at 100+ and climbing….
But as in all things?
Reality knocks….
The FBI thinks the final number for those they expect to arrest could be over 800….
THAT IS creating a problem….
The Federal penal system cannot ingest an additional 800 people in a short time, even for a serious situation as the Jan. 6 crimes….The Justice Dept. pursues the court cases NOT the FBI….And the DOJ is looking for less , not the more in FBI arrests….
In addition?
Some of those 800+ will be able to use the defence that they just came to protest…No commit violence….
Already some the media pointed people have been charged and released already….
We’ll see how this goes….
But in the end?
Fewer than. 100 will probably do more jail time than a month or time served with their holding to be processed……..

The primary objective for authorities is to determine which individuals, if any, planned, orchestrated or directed the violence. To that end, the FBI has already found worrying linkages within such extremist groups as the Proud Boys, Oath Keepers, and Three Percenters, and is looking to see if those groups coordinated with each other to storm the building, according to people familiar with the investigation.
Prosecutors have signaled they are looking to bring charges of seditious conspiracy against anyone who planned and carried out violence aimed at the government — a charge that carries a maximum possible prison sentence of 20 years.
But even as Justice Department officials look to bring those types of cases, they privately acknowledge those more determined and dangerous individuals may have operated within a broader sea of people who rushed through the doors but didn’t do much else, and prosecutors will ultimately have to decide if all of those lesser offenders should be charged….

I think they should all be charged.
Federal courts are loaded with cases involving crimes of much less concern than sedition and insurrection.Even if they’re only charged with minor offenses,triable by Federal Magistrates, which often end with a fine or not more than six months imprisonment ,the point needs to be made that those who engage in an insurrection against the government of the United States will be charged and be called to answer for their actions.
As a practical matter ,very few ,if any ,of these cases are likely to go to trial.A Federal Public Defender is a good friend of mine and as he commented to me, “the only question in most of these cases is what they are going to be pleading to.”

Most will do jail time…
Bit the judges will not want to burden rhe jails with mickey mouse cases…Fining are available….
