No, you simply do not understand the facts of basic judicial politics 101. I don’t have the patience to explain it to you either.
The DA of Manhattan is elected by the residents of the Borough, (just like the Cook County States’ Attorney is), but they are a part of state government, elected via a specific jurisdiction, not city government.
When they say “The People of New York vs..” , they mean the people of the state.

It clearly says “state laws,” While composed of Manhattan, the district is actually “New York County.” New York State is divided into “districts” and New York County (which has many people) is one of those districts.
Yes, everyone who lives there lives in NYC. Irrelevant.
The elected official is elected by the voters of a County (which in this case is smaller than a city, very unusual elsewhere in the country.)
But the entity of government in which this court sits is the State Government. New York City has five districts (each borough, which is also a county).

Each of the five Boroughs* elects exactly one borough-wide non-judicial officer, the Borough President.
*[Manhattan, the Bronx, Brooklyn, Queens & Staten Island]
Each of the five corresponding counties* elects exactly one county-wide non-judicial officer, the District Attorney.
*[New York, Bronx, Kings, Queens & Staten Island (formerly Richmond)]
Neither the Mayor, the Borough President nor the City Council has any authority over the DA.
And if the New York state constitution is like those of other states, I would expect a county’s D.A. to answer, besides to the people of his or her own county, to the Attorney-General of the State of New York, rather than to the Governor (who is elected separately from the Atty-Gen.).

DSDs analysis is correct in my view.
Usually, in most states ,DAs are constitutionally under the “supervision of the State AG.In reality ,however, they operate independently and prosecute all crimes against the State that occur within their jurisdiction .
CG is correct in that violations of state law are fashioned as the State Of (blank) vs. (Defendant).
I’m unsure exactly what is in dispute here or what difference it makes?

Prosecutors ,at any level, except in cases of heinous crimes, generally evaluate a case as to the odds of procuring a conviction.Thousands of cases are never prosecuted, not because the Prosecutor doesn’t believe a crime may have been committed, but because ,due to the difficulty of proving such beyond a reasonable doubt ,the likely (or actual) makeup of the jury ,community interest etc.
Just saying a crime has been committed ;therefore, it will be prosecuted ……ignores the simple reality that prosecuting resources are finite and all sorts of other matters enter into a final decision.

The NYS AG handle’s mostly civil prosecutions….
Criminal cases in the Boro’s are handled by the DA’s….
The usual you mention does NOT happen in NYS….
I pointed out from the jump that ANY DA in any county in NYS primarily use NYS law…
They also handle local criminal or civil cases….
Loccal town or cities may in fact handle their own civil cases…

What was stated was that a DA enforces State law. Somehow, james takes that a a license to pretend to have superiority over others, even as he concedes the point.
