The Supreme Court on Thursday struck down a Hawaii law requiring gun owners to get permission before bringing their firearms into private shops and other businesses open to the public.
In a 6-3 ruling, the high court sided with gun-rights advocates who said Hawaii’s restrictions largely eviscerated the Second Amendment by declaring businesses such as grocery stores, restaurants and parking lots presumptively off limits to people carrying a weapon.
The ruling in Wolford v. Lopez is a victory for the Trump administration, which had urged the Supreme Court to find the 2023 Hawaii law unconstitutional.
Writing for the court’s conservative majority, Justice Samuel Alito said Hawaii’s law “severely hampers” gun owners’ rights by requiring them to seek permission to carry their weapons in a wide variety of places that are essential to daily life. He also rejected arguments that Hawaii’s long tradition of strict gun control laws creates a cultural presumption there that most business owners don’t want guns.
“The Second Amendment has the same meaning in all parts of the United States,” Alito wrote. “It cannot give way to ‘the spirit of Aloha’ in Hawaii.”
Justice Ketanji Brown Jackson, writing for the court’s liberal trio, said the majority was contorting the Second Amendment to give it broader sweep than was merited. “There is no right to carry a gun onto private property without consent (as all agree), and the Constitution does not dictate the form of that required consent,” she wrote….
