A federal judge on Friday dismissed the criminal case against Kilmar Abrego Garcia, siding with the mistakenly deported man in finding that he was the subject of a likely vindictive prosecution.
U.S. District Judge Waverly Crenshaw’s ruling marks an enormous victory for Abrego Garcia, whose case became a flash point in the administration’s heightened efforts to expel noncitizens from the United States after he was sent to his native El Salvador in violation of a court order.
“The Court does not reach its conclusion lightly,” wrote Crenshaw, an appointee of former President Obama who sits on the federal bench in Nashville, Tenn. “The objective evidence here shows that, absent Abrego’s successful lawsuit challenging his removal to El Salvador, the Government would not have brought this prosecution.”
Abrego Garcia was hit with two human smuggling charges last year stemming from a 2022 traffic stop in Tennessee, when he was pulled over for speeding and seen transporting men without luggage. He pleaded not guilty.
The charges followed his removal from the U.S. to a notorious megaprison in El Salvador in a move that a Justice Department attorney described as an administrative error. That attorney has since been fired….

The administration has accused Abrego Garcia, who entered the U.S. illegally nearly 15 years ago, of being an MS-13 gang member, which he denies. The government’s claim rests primarily on an confidential tip supplied by a single informant.
After being deported, Abrego Garcia was transported with more than 100 Salvadoran and Venezuelan men to be held in a notorious megaprison in El Salvador.
The ruling comes as an appeals court shut down a related inquiry led by U.S. District Court Judge James Boasberg in Washington over whether the Trump administration violated his order to halt the March 2025 flights carrying the men to be imprisoned in El Salvador.
Boasberg was set to conduct hearings on whether Trump administration officials lied to the court. Erez Reuveni, the DOJ attorney who was fired after revealing Abrego Garcia was deported in error, has since filed a whistleblower disclosure indicating DOJ attorneys likely lied to Boasberg when they said they were unaware of the status of the flights carrying the men.
While Abrego Garcia was being held, Sen. Chris Van Hollen (D-Md.) traveled to El Salvador to demand his release…..
