Federal judge halts Trump administration’s call-up of National Guard in Portland
A federal judge blocked President Donald Trump’s call-up of 200 National Guard troops in Oregon, ruling on Saturday that Trump’s claims of daily unrest in Portland were “untethered to facts” and risked plunging the nation into an unconstitutional form of military rule.
“This is a nation of Constitutional law, not martial law,” wrote U.S. District Judge Karin Immergut, a Trump appointee.Immergut said Trump’s decision to enlist members of Oregon’s National Guard was based on false claims about nightly unrest targeting federal immigration authorities and buildings in Portland. Though Trump described the city as “war-ravaged” and wracked with violence, police said immigration-related protests had been small, manageable and largely peaceful in the days leading up to Trump’s pronouncement…..
So what does Trump & Co. Do?
Newsom to sue over Trump sending California National Guard to Oregon
President Donald Trump deployed 300 California National Guard troops to Portland after a federal judge blocked the president’s call-up of Oregon’s National Guard, Gavin Newsom said Sunday, vowing to sue the Trump administration in response.
The California governor argued the move — with troops on their way to Portland on Sunday morning — flouted the Oregon order.
“This is a breathtaking abuse of the law and power,” Newsom said in a statement. “The Trump Administration is unapologetically attacking the rule of law itself and putting into action their dangerous words — ignoring court orders and treating judges, even those appointed by the President himself, as political opponents.” A Trump administration spokesperson did not immediately respond to a request for comment….
The overtaking of California troops, once again against the sitting governor’s will, further escalates President Trump’s relentless offensive on Golden State Democrats. His administration has in just the last few weeks lobbed mortgage fraud allegations against Sen. Adam Schiff, canceled funding to California and other blue states amid the government shutdown and threatened to move Olympic and World Cup competitions out of Los Angeles, citing crime…..
Oregon Attorney General Dan Rayfield on Sunday said he is “preparing to take legal action” against President Trump for sending California National Guard troops to the Beaver State.
“We are quickly assessing our options and preparing to take legal action. We’ll continue to share updates as we have them,” Rayfield said Sunday in a post on the social platform X…..
Trump to federalize Illinois National Guard, Pritzker says
President Donald Trump will soon federalize 300 National Guard troops in Illinois, Gov. JB Pritzker said Saturday, a move that comes despite the governor’s opposition.
“This morning, the Trump Administration’s Department of War gave me an ultimatum: call up your troops, or we will,” Pritzker said in a statement. “It is absolutely outrageous and un-American to demand a Governor send military troops within our own borders and against our will.“
Pritzker’s announcement did not say where the troops will be sent. But Trump has long floated sending troops to Chicago as part of his nationwide crime crackdown. “We’re going in,” he told reporters at the White House in early September.
Trump has repeatedly deployed National Guardsmen to cities across America, from Los Angeles to Washington, despite federal law generally prohibiting the use of the military for domestic law enforcement.
And Chicago has been a frequent target of the president’s ire. In early September, Trump posted a meme on his social media platform, Truth Social, with himself cast as a central character in the 1979 film “Apocalypse Now.”
“Chipocalypse now,” the meme read. “Chicago about to find out why it’s called the Department of War.”….
Miller on judge blocking Portland National Guard deployment: ‘Legal insurrection’
White House deputy chief of staff Stephen Miller railed against a Saturday ruling that temporarily blocked President Trump’s attempts to deploy 200 National Guard soldiers to Portland, Ore.
“Legal insurrection. The President is the commander-in-chief of the Armed Forces, not an Oregon judge,” Miller, an architect of many Trump administration immigration policies, wrote in a Saturday statement on the social platform X….
Note…
Stephen Miller is NOT a Lawyer….
