President Donald Trump’s new $100,000 fee for high-skill visa holders only applies to new applicants — not current visa holders who may be on travel outside of the U.S. — according to the White House.
The president’s H-1B announcement on Friday immediately spurred chaos, with companies and immigration lawyers warning travelers to return to the U.S. before midnight on Sunday, when the new policy is scheduled to kick in.
The text of the presidential proclamation signed on Friday does not make this distinction between existing visa-holders and future applicants clear, according to immigration lawyers, and the administration has not released additional formal guidance beyond the proclamation text. According to the proclamation, the secretary of Homeland Security will “restrict decisions on petitions” lacking the new fee for H-1B workers “who are currently outside the United States.”
The White House said Sunday that corporate lawyers and “others with agendas are creating a lot of FAKE NEWS” around the proclamation, and said it does not apply to anyone with a current visa, and only affects future applicants in the February lottery who are outside of the U.S.
A White House official, granted anonymity to discuss the policy, pointed to language in the proclamation that says “aliens whose petitions are accompanied or supplemented by a payment of $100,000” — meaning the payment is only required for new filings, not current visa holders.
“It does not apply to anyone who participated in the 2025 lottery,” the White House said on X post-publication. “The Proclamation does not impact the ability of any current visa holder to travel to/from the U.S.”….

The new fee is likely to face legal challenges.
Trump’s move has questionable legal standing, as Congress is the one that sets parameters for various work visas. Under existing policy, the H1-B visa fees rarely exceed $5,000 in total.
Doug Rand, senior adviser to the former director of U.S. Citizenship and Immigration Services under President Joe Biden, said he expected the move would be challenged in court and “almost certainly” be reversed.
If upheld, the change would restrict a key path to legal immigration.
Major companies urge workers to delay or hurry up plans.
Tech companies, the largest beneficiaries of H-1B visas, will be hit particularly hard, even as the sector has tried to curry favor with the Trump administration.
In the meantime, businesses and immigration lawyers have urged existing H-1B visa holders to return to the U.S. immediately to avoid any prospect of being barred from reentering.
Major tech companies have not commented publicly on the policy — a notable change from their previous criticism of the Trump administration’s immigration policies during his first term.

More than 70 percent of H-1B visa holders in the 2024 fiscal year were born in India, according to U.S. government figures. Opposition leaders in India used the news to frame Prime Minister Narendra Modi as a “weak” leader.
In a statement, India’s foreign ministry did not directly criticize the proclamation, but noted that “skilled talent mobility and exchanges have contributed enormously to … wealth creation in the United States and India.” He added that India would “assess recent steps taking into account mutual benefits.”….
Companies may stop using the program for entry-level jobs.
Janice Flynn, managing partner at Flynn Hodkinson — a London-based law firm that helps clients in industries such as financial services and fashion obtain U.S. visas — said in the longer run, the changes are likely to “freeze the ability for people or for companies to bring in skilled labor into the United States.”
She said the change will be felt hardest by small- and medium-size businesses. She noted that it could also cut off the pipeline of U.S.-trained talent and lead companies to consider whether they want to be based in the country….

The program has been contentious politically.
The H-1B visa program and its lottery system have long faced criticism from both sides of the aisle. Left-leaning politicians say the program can be used to exploit foreign workers and make them susceptible to lower pay. Many of Trump’s supporters have argued for years that the H1-B program takes jobs from American workers.
Previous prominent H-1B visa recipients include first lady Melania Trump, who came to the U.S. in 1996 and became a citizen. Tesla and SpaceX CEO Elon Musk received a student visa in 1995, but he never enrolled in graduate studies at his intended school, Stanford University, and instead worked on his start-up company, The Post previously reported. Musk, who was born in South Africa, later obtained an H-1B visa.
Musk, who heavily funded and campaigned for Trump in 2024, has clashed with anti-immigrant officials in the Trump administration by broadly backing the program.
“The reason I’m in America along with so many critical people who built SpaceX, Tesla and hundreds of other companies that made America strong is because of H1B,” Musk wrote in December.
