The Trump administration is pleading with a federal appeals court to quickly reverse a judge’s directive blocking President Donald Trump’s ability to deport Venezuelan nationals under rarely used wartime powers.
The response from the appeals court judges? Meh.
Justice Department lawyers say the ruling by U.S. District Judge James Boasberg, an appointee of President Barack Obama, is jeopardizing Trump’s agenda, usurping his authority, damaging relationships with international allies, shattering the separation of powers and endangering the American people.
But a three-judge panel of the D.C. Circuit Court of Appeals took no action on the Trump administration’s invitation to immediately strip the case from Boasberg and to lift his initial restraining order, which he issued in part to scrutinize whether Trump’s invocation of the Alien Enemies Act passed legal muster.
Instead, the panel, which includes appointees of President George H.W. Bush, Obama and Trump himself, set a hearing for Monday afternoon — a notable slow-walk, when the administration has described each passing hour as a mounting threat to Trump’s authority.
In fact, the D.C. Circuit’s approach is in line with appeals courts across the country, which have largely rejected Trump’s view of a growing separation-of-powers emergency requiring them to step in urgently and stop lower-court rulings Trump doesn’t like. The Trump administration has described potential “chaos” of rulings requiring employees to be rehired, warned of “intolerable judicial overreach” by a judge who lifted a Trump administration spending freeze and cautioned repeatedly that judges are trying to “superintend” the executive branch by stopping policies that the White House’s adversaries say are flagrantly unconstitutional.
But the appellate panels tasked with reviewing those orders have either rejected those emergency claims outright or tacitly, by moving with far less alacrity than the Trump administration says their concerns demand.
The same appeals court panel in Washington considering the deportations case declined an emergency effort by the administration to block another judge’s order requiring Elon Musk’s Department of Government Efficiency to fork over details about its leadership structure and operations….

On Friday, the 1st Circuit also declined the administration’s emergency effortto cancel funding for education grants they deem related to “DEI” efforts, describing the government’s argument as built on “speculation and hyperbole.” The Trump administration had asked for an “urgent” ruling by March 13 so it could consider going to the Supreme Court. The appeals court instead took nine days before ultimately denying the demand.
Several appeals courts also declined Trump’s call to reinstate his birthright citizenship order…
