President Biden said in a new interview published on Wednesday that he was considering pre-emptive pardons for people President-elect Donald J. Trump considered his political enemies, but he added that he had not yet decided what to do.
“A little bit of it depends on who he puts in what positions,” Mr. Biden told USA Today in the interview, which was conducted Sunday.
Mr. Biden was asked whether he would pardon Liz Cheney, the former Republican representative frequently targeted by Mr. Trump and his supporters for her role investigating the Jan. 6, 2021, mob attack on the Capitol, or Dr. Anthony S. Fauci, the former top federal infectious disease official who oversaw the nation’s Covid-19 response.
“I think there are certain people like, if he were to, I don’t want to name their names,” Mr. Biden said, before asking to speak off the record.
Mr. Biden said that he had appealed to the president-elect in a two-hour Oval Office meeting after the election. “I tried to make it clear that there was no need, and it was counterintuitive to go back and try to settle scores,” Mr. Biden said. But Mr. Trump did not say how he would handle his threats of retribution.
“He didn’t reinforce it; he just basically listened,” Mr. Biden said.
Since late last year, Mr. Biden’s staff has considered what the pardons might look like were Mr. Biden to pursue them, including how to extend executive clemency to a list of current and former government officials for any possible crimes over a period of years….

Can you believe this? Can you believe that, in 2025, Biden and Garland are still operating under Queensberry rules, where nonbinding precedents are controlling and everyone stays hands-off the process? That they are willing to let Trump off the hook again?
Let’s be totally and completely clear: President Biden should publish both volumesof Smith’s report before leaving office. Doing so would serve the public interest and—most importantly—would be legal. Because, as an official action of a sitting president, it falls under the Supreme Court’s blanket of immunity.
Joe Biden didn’t make these rules; but like it or not, the country is now governed by them.

Garland tells Congress he plans to make Jack Smith report on Trump cases available once courts allow
Attorney General Merrick Garland told Congress he plans to make special counsel Jack Smith’s report on the cases against Donald Trump available to committee leaders and, ultimately, the public, once courts allow, marking the formal end of Smith’s office.
Garland noted he believes even the part of the report about the classified documents case should be public someday.
Garland, in a letter sent Wednesday to House and Senate Judiciary Committee chairs and ranking members, outlines how he wants to confidentially provide to them Smith’s volume on the classified documents case and how he wants to release to Congress and to the public the volume on Trump’s 2020 election interference criminal charges….

“Donald Trump urged a federal appeals court late Wednesday to block the release of both volumes of a special counsel report on his two dismissed federal cases — the latest attempt by the president-elect to fight the final remnants of his criminal cases,” the Washington Post reports.
