Good Luck….
THAT IS NOT were Joe Biden is comfortable…..
Biden is a NOT Brawler…….
Now that former President Donald J. Trump is a convicted criminal, the Democratic Party finds itself wrestling with a choice that will help define this year’s presidential race: Should it try to push his felonies to the center of the election?
The route Democrats take may determine not only Mr. Biden’s fortunes but also, they say, the future of American democracy. Widely believing a vengeful Mr. Trump poses a grave threat to the nation, Democrats at all levels of the party are simultaneously thrilled to see him found guilty and fearful that he has a supernatural ability to survive even this political peril.
Post-verdict interviews with more than 50 Democrats — including current and former members of Congress, statewide elected officials, veteran strategists, Democratic National Committee members and local officials — revealed a party hungry to tell voters that Mr. Trump’s conviction makes him unfit and worried that Mr. Biden might not use the bully pulpit of the presidency to press that argument.
“I do think it is the obligation of every Democrat to remind every voter that Donald Trump is now a convicted felon and just how unprecedented this is,” said former Representative Beto O’Rourke of Texas, a Democrat who ran for the presidential nomination against Mr. Biden in 2020….
…
Mr. Biden himself has deployed a two-pronged strategy, speaking carefully about Mr. Trump’s legal problems even as his campaign grows more aggressive: On Friday evening, it fired off an evening statement that referred, for the first time, to “Convicted Felon Donald Trump.”
But Mr. Biden, trying to avoid fueling false claims that he is orchestrating Mr. Trump’s criminal cases, took a restrained tone as he addressed the conviction at the White House on Friday….
…
Fellow Democrats were much less cautious, and happy to say what Mr. Biden did not…
…
Mr. Biden’s comments on Friday about the conviction indicated that he plans to stick with his strategy: Leave the most biting attacks on Trump’s legal troubles to allies and outside groups while emphasizing the rule of law. Campaign aides say abortion rights, democracy and the economy will remain the central focus of the president’s re-election message. In his remarks, Mr. Biden leaned heavily on the idea that the jury had weighed all the evidence and reached a verdict appropriately in the time-honored tradition of U.S. law….

Former Justice Department attorney Sarah Isgur in an NYT article says Hunter Biden should accept a plea deal if he can get one.
She points out the less than 1% of federal cases that go to trial result in acquittals. The vast majority end up in pleas as the Feds generally have air tight cases
jamesb says
Yup…..
Nice conviction rate, eh?
Exception probably will be Trump files case , eh?
Hostile Judge…..
jamesb says
I think Smith messed up on the Florida case
He should have filed in DC….
My Name Is Jack says
Smith didn’t “ mess up.”
In federal court the case must be brought forward in the jurisdiction where the crime occurred.
Quite apparently Smith brought the case forward in Florida because that is where the crime he was charging occurred.
For sure he would have much more wished to have done so in DC if he could have done so.
jamesb says
I understand Jack….
The arugment could have been..
Trying FOR DC, since the property DID come from DC and was taken FROM there…
The crime ACTUALLY DID occur AT the White House (Removal) but was DISCOIVERED in Florida…
My Name Is Jack says
Uh James we all know of your prowess as a “ keen observer” of the political scene ..
However as to the law I would imagine the five or so “ regulars” here as well as the hundreds out there in never never land
Would trust Smith to know what he’s doing rather than unsolicited advice from you.
jamesb says
Jack?
Smith IS a DAMN Good lawyer….
But like U , me and even Trump?
He shits in a toilet ….
And he has won and lost cases…..
I STAND BY my, and others view that he made a mistake in bringing this case to court in Florida where he has a judge ACTIVELY fighting to shit can his case…..
My Name Is Jack says
Jack Smith is a very experienced prosecutor. He has an excellent staff .
Plus, and most importantly, he has access to all the evidence in the case .
Apparently he and his staff made the decision that based on what they had and what they could prove would be more applicable as to Trumps actions in Florida rather than DC.
Smith of course understands the pitfalls of losing an argument as to venue. If venue is brought in the wrong court then there goes the case regardless of its factual validity
Unlike you?
Smith is dealing with facts and his experience in similar situations while you are dealing with a keyboard ,an obsession with Trump and an abundance of ignorance regarding the legal process.
jamesb says
I know he’s Good
I said so
But?
The Florida thing WAS a mistake
CG says
No, bringing the charges in Florida was not a mistake. Smith brought charges in DC on the 1/6 stuff. He is obviously trying to do his job by the book.
Smith likely had no choice anyway, but it certainly would have been a talking point by the defense (“look at where they are trying to charge me, where everyone is a Democrat”)
Even if you fast forward to the future and there were to be a hypothetical conviction in the documents case, that then leads to a big avenue for an appeal as to venue.
You should just admit, you want Trump to be found guilty of anything and everything, regardless of the law or the facts because that suits your political wishes, just like there are people on the other side who want him to be found innocent of everything and anything for the same reason.
All of you are very wrong.
jamesb says
I will be honest CG….
Donald John Trump is a serial liar, sex offended, fraudster, racist, egotistical
,
He should not have been elected President the first time….
If criminal conviction’s keep him out of the Presidency?
Fuckin Aye!
Democratic Socialist Dave says
Ten Senate Republicans, like many in the House, seem to have separated from reality in favor of Trumpworld’s paranoid dementia, threatening United States< Senate business because of the actions of the {state} District Attorney for the County of New York, a New York State< judge and twelve Manhattan jurors.
You see, the <b<REAL criminal (Joe Biden) has somehow weaponized New York’s judicial system against Dear Leader.
From the Deseret News in Salt Lake City:
Sen. Mike Lee and nine other GOP senators have vowed to not allow the confirmation of Biden administration political and judicial appointees as well as Democrat legislation not related to the safety of Americans.
After a Manhattan jury handed down a guilty verdict for former President Donald Trump on 34 felony counts, Lee and other senators circulated the letter on social media.
“Strongly worded statements are not enough,” Lee wrote on social media when he posted the letter. “Those who turned our judicial system into a political cudgel must be held accountable. We are no longer cooperating with any Democrat legislative priorities or nominations, and we invite all concerned Senators to join our stand.”
Sens. J.D. Vance, Tommy Tuberville, Eric Schmitt, Marsha Blackburn, Rick Scott, Roger Marshall and Marco Rubio also signed their names to the letter. Sens. Josh Hawley and Ron Johnson later joined.
Some of the signatories have close relationships with Trump — Lee has been floated as a possible attorney general and Vance, Rubio and Scott are rumored contenders as Trump’s running mate.
“The White House has made a mockery of the rule of law and fundamentally altered our politics in un-American ways,” said Lee and the other senators. “As a Senate Republican conference, we are unwilling to aid and abet this White House in its project to tear this country apart.”
Specifically, the letter outlines three sets of the actions the senators are vowing to not engage in due to the trial and its result.
The senators said they wouldn’t allow increases in funding for the administration that aren’t related to security — “or any appropriations bill which funds partisan lawfare,” the senators wrote. They also won’t confirm political and judicial appointees from the administration. And finally, the senators said they won’t “allow expedited consideration and passage of Democrat legislation or authorities that are not directly relevant to the safety of the American people.”
The Democrats have a slim majority in the Senate currently and if the senators remain committed to not allowing confirmations and blocking appropriations bills, business could slow down….

He has them “conservative values” and he is for “ law and order.”

My post about Mike Lee is sitting, I think, in moderation.
My Name Is Jack says
As is mine in response to the moderators mistaken post as to Smith above.
Tiresome
CG says
The alleged crimes, as detailed in the indictment, all happened in Florida.
CG says
one may have happened in New Jersey.
jamesb says
Indeed……
But the taking was FROM Washington DC
jamesb says
The files WERE taken from the White House in Washington DC…..
They where RECOVERED IN Florida
The actual CRIME occurred in Washington DC
CG says
No, willfully retaining them when asked to return them was the crime. That is what is supposed to differentiate what he did and what Biden did when Biden took documents from Washington D.C.
Sharing classified information with the author of the book about Mark Meadows in Florida was the crime. Having them not being properly secured at Mar-A-Lago was the crime. Read the indictment.
CG says
And the first thing his lawyers would claim was that he was still President of the United States on the morning of 1/20/21 when he arrived in Florida.
He was definitely still the President when he left DC
jamesb says
Probably…..
jamesb says
And we’re back to the private vs official actions again, eh?
He didn’t take them for his historical liberty, eh?
jamesb says
The keeping sealed the crime
But taking them to not give back originated IN WASHINGTON DC
CG says
No, what you are saying is incorrect. Looking at it objectionably, there is no way you could have charged him with this case in a DC venue.
He was President and thus at the time he was President, had the right to those documents. While he was President, he could have them anywhere he wanted or declassify them. The issue was that he did not declassify them when he was President.
It is a no-brainer that he would have to be charged in Florida for that case.
jamesb says
CG?
Like someone stealing a TV?
If they get caught three states away?
The crime occurred where it the property WAS….
Now I’ll grant u that Trump WILL argue that he WAS President?
And he would argue to an incredulous jury that fucking TRUCK LOANS of classified documents moved to his home in unsecured places WAS OFFICIAL,…
Yup!
That would work?
CG says
“Taking them to not give back” sounds like quite a ridiculous legal notion to try to make.
Did Biden (or Pence) take documents with the intent to give them back? It’s completely irrelevant.
In regards to this, Trump did not break the law, until he was in Florida and until he was no longer President. Had he cooperated and returned the documents, he would not have been charged.
jamesb says
Nope
Them guys didn’t have TRUCK LOADS OF files and Yes gave the stuff up on the first round….
CG says
This is obviously above your level of comprehension.
jamesb says
In fact I DO understand and offer a judgment call on Smith, who made a mistake and will most assuredly atone for his mistake with the DC Jan 6 trial if the Supreme’s let him
jamesb says
I have my view……..
I was right on the NYC case
