A federal appeals court on Tuesday rejected former President Donald J. Trump’s claim that he was immune to charges of plotting to subvert the results of the 2020 election, ruling that he must go to trial on a criminal indictment accusing him of seeking to overturn his loss to President Biden.
The 3-0 ruling by a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit handed Mr. Trump a significant defeat, but was unlikely to be the final word on his claims of executive immunity. Mr. Trump is expected to continue his appeal to the Supreme Court — possibly with an intermediate request to the full appeals court.
Still, the panel’s 57-page ruling signaled an important moment in American jurisprudence, answering a question that had never been addressed by an appeals court: Can former presidents escape being held accountable by the criminal justice system for things they did while in office?
The question is novel because no former president until Mr. Trump had been indicted, so there was never an opportunity for a defendant to make — and courts to consider — the sweeping claim of executive immunity that he has put forward….

“For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant,” the panel wrote. “But any executive immunity that may have protected him while he served as president no longer protects him against this prosecution.”….

We cannot accept that the office of the Presidency places its former occupants above the law for all time thereafter. Careful evaluation of these concerns leads us to conclude that there is no functional justification for immunizing former Presidents from federal prosecution in general or for immunizing former President Trump from the specific charges in the Indictment. In so holding, we act, “not in derogation of the separation of powers, but to maintain their proper balance.” See Fitzgerald, 457 U.S. at 754.

BREAKING: DC Circuit gives Trump only until 2/12 before it will issue the mandate, which would permit Chutkan to go forward. So Trump would need a stay to extend that date.

In the 1992 Democratic primaries there was a Southern California mayor named Larry Agran that was sometimes listed as a “major contender” and may have been on a debate stage with Bill Clinton, Jerry Brown and Paul Tsingas once if I recall.

Claude Kirk was the Republican Governor of Florida between 1967-1971, the first of that party since Reconstruction. Apparently, he made several attempts for a political comeback in both parties over the next couple of decades that must have included running for President in NH as a Democrat in 1974.
Via the Wayback Machine, I recently came across a Politics1 haloscan thread (almost none are archived, but occasionally one is found) from 2005 in which Larry Agran is discussed a lot. According to someone from California, he was the inspiration for the father character on “The OC” who I vaguely recall was some sort of crusading attorney. I had mentioned that I went to High School with somebody named Agran who had said that his uncle had recently run for President. Could have been true.

Wikipedia & Dave Leip tell me that Larry Agran, one-time Mayor of Irvine, California (and to my surprise a comrade in DSA) won 24,784 votes (0.87%) in the 1992 Democratic primary held on the day that I left the Golden State, Tuesday the 2nd of June (Coronation Day), 1992.
Wikipedia puts his national vote in the middle of a second tier among several better-known names:

Until Donald Trump became a Florida resident and ran for te-election in 2020, the state of Florida’s citizens had a remarkable distinction: no presidential or vice-presidential nomination by any significant party (inc. Socialist, Prohibition, Libertarian, etc. — unlike my own still-Little Rhody, which at least provided VP candidates for the Prohibitionists in 1900 and the Progressives in 1952).
Before the 1920’s Florida was a small state that was nearly sure to vote Democratic, so (like R.I. today) no electoral votes would be changed by nominating a Floridian. So it’s not so surprising that no Florida governor (or Senator or Representative) has ever won a major-party nomination.
Now Florida has the Union’s third-greatest population and a belwether Electoral College record that closely matches the nation’s (since 1925, Florida has voted against the Electoral College winner in only 1960, 1992 & 2020).
