Until Trump is convicted in a court of law by a jury of causing an insurrection?
He will not ,nor should he be, excluded from the ballot.

The only way there will be broad acceptance is if a jury of average people comes back with a guilty verdict and says yes Trump caused an insurrection ….
Then excluding him from the ballot using the 14th amendment will have some validity.
But just having election commissions, secretaries of state,etc ,all political positions ruling him off the ballot ,is going to do nothing but stir up a political hornets nest.

Two lawyers on the 14th Amend case that Trump’s lawyers are answering to the Suprmeme’s….
Point 1) The 14th amend does NOT depend on a ‘guilty’ verdict…It merely points to someone being cited for same….
Pont 2) The state basis for THEIR disqualifications are several and varied….
Point 3) The Supreme’s decision should be very technical….
The High Court could also throw the whole thing to Congress also…..

My comment as to a jury conviction of Trump for insurrection was not meant as a requirement for the Supreme Court to decide that a state could bar him from the ballot.
Rather my point was that I think such is required to make such an action like that saleable to the public.
The action in Maine, whereby an appointed official decided to declare Trump guilty of fomenting an insurrection , is an example of the type of action that is fraught with problems in my view.

The political process of the election supersedes ANYTHING legally against him…
The argument that the voters should decide?

I have said from the beginning that there is no way the Supreme Court is going to allow individual states to bar Trump from the ballot.
I have listened and to all the legal arguments as to the applicability of the 14 th amendment ,the definition of “ insurrection ,” etc.
Nothing I have heard has changed my mind in the slightest.
It isn’t going to happen. This whole thing is a waste of time ,has not caught on with the public, and indeed may be counterproductive.

Any normal person wd lead his S Ct brief by saying “I did not engage in insurrection,” but since Trump is embracing that conduct, not condemning it, he relegates that to a later aside. Even the Republican committee brief does not argue that Trump didn’t engage in insurrection.
