Losing the seat is a key point. Republicans have overperformed in the state in major elections over the last two years, and the Senate map is brutal for Democrats this year. Menendez is a dicey bet at best next year, and could juice Republican enthusiasm to the point of winning this race, plus key House races. At the moment, I’m not cynical enough to think Biden can lose NJ even with the party in a mess, but we’ll see.

There are a lot of concrete examples that could be provided to dispel a false narrative of “scandal plagued Democrats always quit” and “scandal plagued Republicans never quit.” As it relates specifically to the U.S. Senate over the last 30 years or so, the number of Republican Senators who have either resigned under a cloud or dropped a reelection bid under a cloud outnumbers that of Democrat Senators.
A sitting United States Senator under indictment (and not even for the first time) for a charge of accepting a bribe from a foreign government to influence policy is pretty unique. Right now, Menendez is saying he will not resign and is still running for reelection. Again, the charges against him are pretty unprecedented for a sitting U.S. Senator.
The only Senator who was under federal indictment anytime remotely recently was Ted Stevens in 2008. His refusal to resign or not run for reelection cost Republicans a Senate seat for six years in a state they would otherwise not have lost. (Stevens was eventually exonerated on the charges.)
Putting all of this aside though, the idea that someone who might want Democrats to succeed politically thinks Menendez sticking it out and “fighting” is somehow going to reflect well on his party as well as thinking that people in his party insisting that he abide by basic standards is somehow to be looked upon poorly is pretty lacking in common sense, not to mention very unprincipled.

Now, in regards to George Santos.Of course, he should resign. Just about every Republican in New York has said he should, but there are also differences. For one thing, the charges against him and the potential time he may serve behind bars is nowhere near as significant as what Menendez has been charged with.
Unlike a House vacancy, a Senate vacancy in NJ can be filled immediately by the current Democrat Governor.A new Democrat could be in the Senate tomorrow and serve until 2025 if Menendez resigned today, so, it should be a slam dunk for Democrats to want to see him go.
Santos’s fellow Republicans in NY want him out because he hurts them by association. Menendez hurts Democrats by association as well. Santos is almost certain to be defeated in a primary. if not, the seat will go Democrat.
Mendendez not resigning makes it more likely than would otherwise be the case that the Senate seat in NJ could be won by a Republican next year.

There are practical differences between a House Member getting indicted and a Senator getting indicted. It happens far less frequently in the Senate.

That’s the whole list. Menendez is accused of taking bribes from Egypt to influence policy (and for the record, I have agreed with Menendez on many foreign policy matters.)
If a House Member quits (which they should when appropriate), the people are of the district are temporarily without a Representative.
If a Senator quits in NJ (and most other states), the vacancy can be filled immediately. Since Murphy won narrowly in 2021, he would appoint a Democrat. Every single Senate Democrat, including Schumer, is wanting this to happen, whether they have the guts to say so publicly or not.
