It appears that the Supreme’s have left Alito and Thomas alone by voting to LET a transgender girl compete middle school sports events….
The Supreme Court ruled on Thursday that a transgender girl may compete on the girls’ cross country and track teams at her middle school in West Virginia while her appeal moved forward, signaling that a majority of the justices are not ready to enter another battleground in the culture wars.
The Supreme Court’s brief order, which let stand an appeals court’s temporary injunction, gave no reasons, which is not unusual when the justices rule on emergency applications filed on what critics call the court’s shadow docket.
Justice Samuel A. Alito Jr., joined by Justice Clarence Thomas, issued a dissenting opinion indicating that states are entitled to enact laws “restricting participation in women’s or girls’ sports based on genes or physiological or anatomical characteristics.”
The case, involving conflicting conceptions of inclusiveness and fairness in sports, arose from a 2021 law in West Virginia that barred boys from competing on girls’ teams in public schools. The law made distinctions based on what it called “biological sex,” which it defined as “an individual’s physical form as a male or female based solely on the individual’s reproductive biology and genetics at birth.”…

The Biden administration proposed a rule change on Thursday that would forbid schools from enacting outright bans on transgender athletes from teams that are consistent with their gender identities, but offered flexibility for “fairness” and other exceptions that are likely to apply at the highest levels of competition.
Weighing in on the highly charged debate about transgender athletes and school sports, the Biden administration’s proposal would make “categorically” banning all transgender students from teams that are consistent with their gender identities a violation of Title IX, which prohibits sex discrimination at educational institutions that receive federal funding.
But it would also allow K-12 schools and universities to limit the participation of transgender students when including them could undermine “fairness in competition” or potentially lead to sports-related injuries.
Under the proposed rules, elementary school students would generally be able to participate on school teams consistent with their gender identities. But for older students, questions of fairness and physicality could come into play….

Republicans have seized on transgender rights ahead of 2024, with policy proposals including punishing doctors who treat transgender youths to barring transgender women and girls from playing on school sports teams with their peers.
In a February campaign video, former President Trump pledged to enact a federal law that recognizes only two genders if he is reelected in November, claiming that being transgender is a concept that has only recently been manufactured by the “radical left.” The former president in the video also announced his intent to enact close to a dozen policies if he is elected in 2024, all of them targeting transgender people….

Despite consensus among most major medical organizations that gender-affirming care for both transgender youths and adults is safe and medically necessary, more than 100 state bills introduced this year seek to restrict access to care, according to the American Civil Liberties Union.
Meanwhile, state Republican parties across the country have targeted transgender identities in their party platforms. In its official party platform adopted last year, the Texas GOP said state Republicans should oppose “all efforts to validate transgender identity” and said the party recognized homosexuality as an “abnormal lifestyle choice.” Maine Republicans similarly adopted a platform that promised to classify the “promotion of biological genders other than those of male and female homo sapiens” in public schools as child sexual abuse under state law….
