Four members of the far-right Oath Keepers were found guilty on Monday of attempting to derail the transfer of power from President Donald Trump to Joe Biden on Jan. 6, 2021.
A jury found that the four men — Roberto Minuta, David Moerschel, Joseph Hackett and Ed Vallejo — joined a conspiracy with other Oath Keepers to forcibly prevent Biden from taking office.
It’s the second trial of Oath Keepers leaders to result in seditious conspiracy convictions stemming from the Jan. 6 attack on the Capitol. The group’s founder, Stewart Rhodes, and ally Kelly Meggs were convicted of the rare charge in November, while three others were acquitted of seditious conspiracy but convicted of other felony offenses.
Seditious conspiracy, which requires prosecutors to prove that defendants planned to forcibly prevent the execution of a U.S. law, is the gravest charge to emerge from the Jan. 6 attack. The government has secured 10 convictions for seditious conspiracy since last year, including three other Oath Keepers and a member of the far-right Proud Boys who pleaded guilty to the charge. Five Proud Boys leaders, including the group’s national chair Enrique Tarrio, are currently on trial on seditious conspiracy charges, as well….

Members of the group remained stoic as the verdict was read aloud. Seated in a row of the public gallery were Tarrio’s mother; the mother of Ashli Babbitt, a Jan. 6 rioter who was shot and killed by a Capitol Police officer while trying to breach the House chamber; and Nicole Reffitt, whose husband is serving a seven-and-a-half-year sentence for obstruction of Congress’ Jan. 6 proceedings. They were also present earlier in the day when Jan. 6 defendant Richard Barnett — who is featured in famous images with his feet on a desk in then-Speaker Nancy Pelosi’s office suite — was found guilty on eight charges related to the breach of the Capitol.

Juror in Oath Keepers Trial Talks
Jurors in the recently concluded trial of six Oath Keeper affiliates were “horrified” by a defense attorney’s effort to provoke his autistic client into a “breakdown” on the witness stand, one of those jurors said Tuesday in a newly released interview, Politico reports.
Said the juror, identified only as Ellen: “His defense attorney tried to get him to fall apart by yelling at him and not letting him wear his headset. He was torturing his client to get us to feel sympathy.”

Proud Boys Leader Found Guilty of Seditous Conspiracy
Former Proud Boys chairman Henry “Enrique” Tarrio and three other members of the extremist group were found guilty Thursday of seditious conspiracy in the Jan. 6, 2021, attack on the U.S. Capitol, the Washington Post reports.
New York Times: “The verdicts, coming after seven days of deliberations in Federal District Court in Washington, were a major blow against one of the country’s most notorious far-right groups and another milestone in the Justice Department’s vast investigation of the Capitol attack.”

“A Pennsylvania man who threw a folding chair at law enforcement and repeatedly used pepper spray on police during the January 6, 2021, attack on the US Capitol was sentenced Friday to more than 14 years in prison – the longest of any January 6 defendant so far,” CNN reports.

The Justice Department appears poised to win a significant appeals court victory in a case that threatened to upend hundreds of Jan. 6 prosecutions for obstruction of Congress’ electoral vote-counting session.
Two members of a three-judge panel of the D.C. Circuit Court of Appeals hinted strongly Thursday that they largely agree with prosecutors’ interpretation of the Enron-era obstruction law that the Justice Department has leveled against hundreds of Jan. 6 defendants.
The law, known as “obstruction of an official proceeding,” carries a 20-year maximum sentence and is the most severe felony charge — other than seditious conspiracy — that prosecutors have doled out in Jan. 6 cases. As of May 9, more than 300 defendants had been hit with the charge….
