To quash or not to quash: Fulton County District Attorney Fani Willis spelled out the scope of her office’s investigation and its focus on Sen. Lindsey Graham (R-S.C.) in a Thursday federal court filing responding to his attempts to challenge a special grand jury subpoena. It’s the latest step in Willis’ fast-paced investigation into efforts by former President Donald Trump and his allies to overturn the 2020 election in Georgia.
The scope: Willis indicated a “central focus” of her investigation was Trump’s now-infamous Jan. 2, 2021, call to Georgia Secretary of State Brad Raffensperger asking him to “find 11,780 votes” for him. Raffensperger resisted Trump’s pressure and later testified to the Jan. 6 select panel and the Fulton County investigation. Willis’ investigation has resulted in subpoenas for many of Trump’s allies and Republican lawmakers who boosted Trump’s efforts to seize a second term he didn’t win.
Why Graham: Graham, who was Senate Judiciary Committee chair at the time, called Raffensperger in the aftermath of the election as well — apparently in an effort to ask Raffensperger to toss some 2020 ballots. Graham has characterized the calls as benign, but Willis said his recollection was “not consistent” with accounts of the call from Raffensperger and his top deputy, Gabriel Sterling….

The South Carolina Republican was subpoenaed in Willis’ investigation last month and has resisted the summons, citing speech and debate protections for members of Congress, among other concerns. The speech and debate protections, however, did not apply to the grand jury subpoena, according to Willis’ filing, because the privilege did not extend to third-party crimes not related to legislative actions….

Lindsey Graham appeared alongside Ron Wyden on SOTU and said that Joe Biden absolutely deserves some credit for bipartisan successes in Congress. He also said the 2020 election was not stolen. Translation? PLEASE don’t make me testify in Georgia – I’m a nice and reasonable guy.

The appeals court said in a two-page order that Graham’s attorneys and prosecutors for Fulton County District Attorney Fani Willis needed to flesh out arguments about whether Graham is entitled to have the federal courts place legal guardrails on the questioning Graham could face. The 11th Circuit panel’s order said that those arguments should be presented first to U.S. District Court Judge Leigh Martin May, who issued a ruling last week rejecting the arguments Graham’s team raised under the Constitution’s speech or debate clause — which immunizes lawmakers from most legal consequences for actions relating to their lawmaking responsibilities….
