Senate Minority Leader Mitch McConnell (R-Ky.) signaled Monday that Republicans, if they win back control of the chamber, wouldn’t advance a Supreme Court nominee if a vacancy occurred in 2024, the year of the next presidential election.
“I think it’s highly unlikely — in fact, no, I don’t think either party, if it were different from the president, would confirm a Supreme Court nominee in the middle of an election,” McConnell told radio host Hugh Hewitt.
McConnell was asked if a GOP-controlled Senate would take the same tack in 2024 that it did in 2016, when they refused to give Merrick Garland, Obama’s final Supreme Court pick, a hearing or a vote on his nomination to fill the vacancy created by the death of Supreme Court Justice Antonin Scalia.
Republicans subsequently confirmed Amy Coney Barrett, then-President Trump‘s third Supreme Court nominee, in 2020, locking in a 6-3 conservative majority. The move, which sparked howls from Democrats, set a new record for how closely before a presidential election a Senate had confirmed a Supreme Court nominee.
McConnell and Republicans have defended their strategy by noting that in 2016 there was a split in what party controlled the Senate and the White House, compared to in 2020 when they were both controlled by Republicans….

You literally referenced “super majority” in your first line. Just own up to being wrong about something. It’s not a sin.
There is zero chance that Sinema would vote against a Biden Supreme Court pick. Zero chance. Virtually no chance that Manchin would vote against one either, barring the person being a complete extremist. And yes, at least a handful of Republicans would also vote for someone mainstream including Lindsey Graham apparently.
All this is moot though because there is no vacancy and Justice Breyer does not seem to want to retire.

“Super Majority” means 67 votes for one thing, so that is not even the same thing as 60 to prevent a filibuster.
The filibuster does not apply for judges. 50 votes is all that is needed.

McConnell does not currently control the Senate, unlike past years.
If Republicans win the Senate after 2022, in theory, he could prevent any nominee from coming up for a vote.
This is why Democrats want Breyer to retire *now.*

The way to understand Mitch McConnell’s actions on blocking Garland in ‘16, to reversing that standard for Barrett in ‘20, to suggesting he’d block Biden in ‘23/‘24:
He is betting that Democrats won’t do anything to retaliate when they have power. So far that bet is paying off.

*If* Breyer were to step down, during the time the Democrats controlled the Senate, there would be no issue.
The person chosen would almost certainly be Kentanj Brown Jackson, the African-American female judge who was just confirmed to the DC Court of Appeals, essentially the waiting room for a SCOTUS vacancy.
She is believed to be pretty liberal, but was confirmed 53-44. Sinema was a Yes. Manchin was a Yes. So were Republicans Collins, Murkowski… and Lindsey Graham.
A SCOTUS vote on her during the current Senate term would almost certainly generate the exact same vote.
Of course, I hope Breyer stays put.

This whole “discussion” is because James didn’t understand yesterday that there can be no filibuster on a judicial nomination.
He was yakking that McConnell could use “rules” to keep from having a vote.
There are no such rules.
In essence,if Breyer resigned today and Biden nominated a successor then that person would get a vote and ,if all the Democrats voted for that person ,they would be confirmed and there is no “rule”McConnell can use to stop it.
Rather than simply letting his ignorance go?He continues to belabor the point, in very Trumpian fashion I might add.
