President Biden will sign an executive order Friday establishing a commission to study whether to add seats to the Supreme Court, the White House announced, fulfilling a promise he made on the campaign trail.
The commission will be chaired by former White House counsel Bob Bauer and Cristina Rodriguez, a Yale law school professor and former deputy assistant attorney general, and include a bipartisan group of legal experts, former officials and reform advocates, the White House said.
It will delve into the issue of potentially expanding the court – an idea that has been floated by some progressives but heavily criticized by Republicans….

Always a good way to bury an idea one doesn’t wish to directly confront.
Establish a Commission.
A years or so down the road,they will issue a report which will be relegated to a back page of the newspaper or a 10 second mention on cable news and the “idea” will slowly melt away .

FDR lost far more than he gained with the last serious such proposal in 1937. The Conservative Coalition made huge gains in the 1938 elections, despite a presidential political tour that aimed unsuccessfully at replacing rebellious conservative members of Congress with ones more favorable to the New Deal.
On the other hand (and this is no argument on my part for making such proposals), the Supreme Court did treat New Deal or post-New Deal legislation with less hostility — “the Switch in Time that Saved Nine”
