The second impeachment trial of former President Donald Trump begins in the Senate on Tuesday, where senators will be confronted with the violent events of the January 6 riot and whether Trump is culpable for inciting the insurrectionists that attacked the Capitol and placed their lives in danger.
Ahead of the opening arguments, the House impeachment managers filed their final pretrial legal brief that rebutted the Trump team’s filing from Monday, in what amounts to a preview of the arguments that will play out in the Senate in the coming days.
The managers intend to lay out a “devastating” case that Trump is responsible for the riot, from his actions in the weeks leading up to it and his failure to act to stop it, senior aides to the House impeachment team said Tuesday.
The aides would not tip their hand on whether they might call witnesses at the trial, but they told reporters that the managers’ argument would be a detailed and compelling case that leaves no doubt about Trump’s guilt. The managers planned to present new evidence, the aides said, but they would not elaborate.
The case would be like a “violent crime criminal prosecution,” one aide said….

I’m butting in here without reading the previous comments to express my frustration with how bloody awful the President’s (non-Congressional) team is.
The first lawyer was so long, circumspect and discursive that his apparent point at the end was buried at the end in a First Amendment argument that was very poorly anchored to Trump’s agitation and incitement.
Mr Schoen, probably because his own time had been so greatly curtailed by his predecessor’s lazy loquacity, is trying to cram a 100 or 120 page book into heaven knows how little time. I can’t follow his machine-gun delivery over time, with distractions such as Chairman Mao.
Should Jack ever teach Legal Argument, he might use this as a Horrible Example of what not to do.
From my own experience on stage and in the press, the lawyers don’t seem to understand the two-way interaction between performer and audience, teacher and class, or lawyer and judge or juror.
(By the way, that’s what’s wrong with Stephen Colbert today; without a real audience, he just can’t judge his own timing and material.)

Will any others join them in voting to convict…As we all know the trial no matter how good the Democrats argument is (and the team knocked it out of the park on the first day) won’t convict, but are there any more defections from the GOP. I know that probably 45 will vote not to convict based solely on the idea (political cover) that the trial is unconstitutional, but can there be one or two more that say fuck it, the guy was a disaster, he is guilty and fucked not only the GOP but fucked the whole country?

McConnell was still Majority Leader throughout the first three weeks of January. He adjourned the Senate until the 19th. The House didn’t have anyone to deliver the Article of Impeachment to.
