Lawyers for the former F.B.I. deputy director Andrew G. McCabe, a frequent target of President Trump’s, have asked federal prosecutors whether a secret grand jury refused to indict him, which would be a sign that the government is struggling to make a case against him.
In a letter sent late Thursday, defense lawyers asked whether a grand jury had considered charges against Mr. McCabe, who is being investigated over whether he lied to internal investigators about interactions with the news media. The letter came shortly after the Justice Department told Mr. McCabe’s lawyers that it had rejected their pitch to the deputy attorney general to drop the case.
“It is clear that no indictment has been returned,” the lawyers wrote, citing coverage of the case by The New York Times and The Washington Post. A grand jury hearing evidence that was recalled on Thursday after months of inactivity left for the day without any sign of an indictment, The Post reported. None had emerged on Friday.
The letter was the latest attempt by Mr. McCabe to stave off charges in the highly unusual and politically charged case. His lawyers have denied that he intentionally lied during an internal inquiry and have said that he is being singled out, noting that similar cases were typically handled administratively, not through criminal prosecution….

“The Justice Department suggested in a filing Wednesday that it had no immediate plans to prosecute former FBI Deputy Director Andrew McCabe, saying it would no longer try to keep documents related to Mr. McCabe from being publicly released because of an ongoing enforcement proceeding,” the Wall Street Journal reports….

It seems that McCabe is NOT gonna be charged with anything and McCabe IS gonna sue the Justice Dept. for firing him in a untimely manner…And?…One Federal judge IS pissed about how the DOJ is handling the McCabe case…
A federal judge excoriated Justice Department officials Thursday for their handling of potential criminal charges against former Deputy FBI Director Andrew McCabe, saying the continued uncertainty over the prosecution was unfair to McCabe and the public.
“This is not a hard case,” U.S. District Court Judge Reggie Walton said. “I was a good prosecutor for a long time. Deciding whether or not you’re going to charge someone with false statements or perjury is not that hard, factually or legally — maybe politically, but not factually or legally.”

Walton, a George W. Bush appointee overseeing a Freedom of Information Act lawsuit filed by a watchdog group to obtain records about McCabe’s firing, complained at a hearing Thursday afternoon that the Justice Department claims about an ongoing potential prosecution of McCabe may have been a “smoke screen” to persuade the judge to forestall the case demanding documents….
