Supreme Court Justice Ruth Bader Ginsburg’s well-known candor was on display in her chambers late Monday, when she declined to retreat from her earlier criticism of Donald Trump and even elaborated on it.
“He is a faker,” she said of the presumptive Republican presidential nominee, going point by point, as if presenting a legal brief. “He has no consistency about him. He says whatever comes into his head at the moment. He really has an ego. … How has he gotten away with not turning over his tax returns? The press seems to be very gentle with him on that.”
Ginsburg’s comments came in a previously scheduled interview related to my research for a book on Chief Justice John Roberts. I took a detour to raise the reverberations from her criticism of Trump to The Associated Press and The New York Times in recent interviews. “I can’t imagine what this place would be — I can’t imagine what the country would be — with Donald Trump as our president,” she had said in the Times interview published Monday.
Trump responded Wednesday morning by calling on Ginsburg to resign…..

This does raise all kinds of disturbing questions about Justice Ginsburg’s impartiality and detachment when (necessarily) she will have to rule or vote on different administration and presidential interests, most notably the argument over the foreign emoluments clause of the Constitution [Article I, end of section 9].
She’s providing a ready-made argument for the President’s defenders if she doesn’t recuse herself from such cases and then rules against the Executive.
And if she does (as I think she probably should) recuse herself from such cases, she’s gratuitously given away a possible vote against President Trump or his administration.

We just had a nominee for the Court testify that the Clintons are conspiring against him and trying to stop his nomination and then referencing “payback.” But Ruth Ginsburg should recuse herself?!!
She should refuse to have her picture taken with a sexual predator if he makes it on to the Court. None of the women Justices should agree to appear publicly with a grab ass aging Preppy.
But, by all means, let’s worry about a comment by that woman Justice.

However, I completely agree with you about Brett Kavanaugh’s lack of impartiality. He not only expressed his disagreement with his political opponents in the relatively mild way that RBG did, he went (in a confirmation re-hearing, of all places) completely unhinged in the Clintonphobia he must have developed at Ken Starr’s side and in paranoid hatred for the Democrats.
He should recuse himself not only from any cases at all, but from being nominated in the first place.

I find misogyny unpleasant, I find Republicans repugnant, and I find putting a sexual predator on the Court unthinkable, but that is just what the Republican Majority is about to do.

And if those Ginsburg comments were as far back as 2016, that does put a rather different light on them.
She made to comments around July 16, 2016 about Trump….
She later said she regretted making the comments publicly as some went after her impartiality….
