This IS a BIG legal question in the Donald Trump case…
While Robert Mueller has been impaneled to do a criminal investigation of the 2016 Presidental election and the possibkle influence of the Russians….
He has also been authrized to investigate the President of the United State Donald Trump and ANY criminal actions thereof ….
There is a catch….
*There is a... ‘Justice Department’s Office of Legal Counsel …. memo in 2000, concurring and elaborating on one from 1973, contending that a sitting president cannot be indicted because it would “interfere with the President’s ability to carry out his constitutionally assigned functions and thus would be inconsistent with the constitutional structure.”..
Actions in the Nixon and Bill Clinton cases contrast against the OLC memo…
In both prior Presidential cases the probers’ lawyers say they could indict the people they where after…
But for Mueller they suggest he should ask the OLC for a fresh call….
We ALL agree the call would favor Trump….
Soooooo?
We’re back to the status quo….
Mueller has to go to Ron Rosenstein, his boss, for how his final throwdown comes out….
It appears that the basic is already worked out, in that Mueller has told the Trump lawyers that they will be presenting SEVERAL seperate reports on the different paths he is going down and investigating….
It will be up to the Republican cointrolled House wither to launch impeachment hearing, or after Jan. 1st, 2019 a possible Democratic controlled House….
The view is thgere would NO impeachment conviction from the Senate unless the Mueller or other factors would be so convicing that Trump would HAVE to be kicked out…
